It may be requested by natural persons of legal age, with full civil powers, who meet the requirements of these terms and the regulations in force on protected housing in Málaga; if there is a family unit, the application refers to its holders.
No, neither the applicant nor any member of the family unit may hold ownership of another home, protected or free-market, nor hold a real right of lifelong use or enjoyment over it, either at the time of submitting the application or on the date of signing the award document.
Yes, the awarded home must be the habitual and permanent residence of the applicant family unit and must be occupied within the legally established deadlines.
Yes, the applicant must have been registered for at least one year in the municipality of Málaga in the period immediately prior to the date of submitting the application. It is not necessary for all members of the cohabitation unit to meet this requirement; it is enough for the applicant to meet it.
At the time of submitting the application, you must have already submitted an application as a protected housing applicant in the Municipal Registry of Protected Housing Applicants of the municipality of Málaga, keeping that application active at least until the lease contract is formalized, in accordance with the actual situation of the family or cohabitation unit and its income.

You must prove minimum income per family or cohabitation unit (last completed fiscal year) of: €21,000 annually for 1-bedroom homes (including the dependency home), and €23,300 annually for 2-bedroom homes (including adapted homes).
The maximum income per family or cohabitation unit is equivalent to 2.5 times the IPREM, with corrective coefficients applied, resulting in the following limits: €24,418.60 annually for units of 1 member, and €32,307.69 annually for units of 2 members or 3 or more members.
The family income considered is that defined in the protected housing legislation, taking as reference the general and savings taxable bases of the IRPF (personal income tax) (in the 2024 return, boxes 435 and 460), for the last tax period whose filing deadline has expired, of the members of the family unit.
Annual income is calculated by adding together the general and savings taxable bases of each member of the cohabitation unit with income.
For this purpose, the amounts of the general and savings taxable bases are considered, as regulated in articles 48 and 49 respectively of Law 35/2006, of November 28, on Personal Income Tax, corresponding to the return or returns filed by each of the members of the family unit for whom the home is intended, relating to the last tax period whose filing deadline has expired, at the time the application is submitted.
Annual net income is obtained from the last three payslips, certificates of state-recognized benefits, and income from economic activities, where applicable.
You must include the income of all members of your cohabitation unit who receive any type of income.
The rent will be determined in accordance with the regulations on publicly
protected housing and
calculated based on the usable surface area of the home and its annexes, applying
the maximum
prices legally established per square meter:
Maximum rental price €/usable m² of home = €5.54.
Maximum rental price €/usable m² of annexes = €3.75.
In addition, the chargeable expenses and services set out in the
lease contract will be added to the rent.
The chargeable expenses will be those arising from the community services of the development (among others, and on a purely indicative basis, those corresponding to gardening, cleaning, maintenance, the pool, and supplies for the common areas), which may be charged monthly to tenants together with the rental fee for the home and its annexes.
Yes, as a tenant you must contract and manage the individual utilities for your home (electricity and water). However, the lease contract will include the information necessary to facilitate this process.
Yes, as a solvency requirement, the total annual rent to be paid (home rental, linked annexes and estimated chargeable expenses) cannot exceed 30% of the annual net income of the cohabitation unit (effort rate).
The effort rate is an indicator that measures what percentage of a cohabitation unit's annual net income is spent on paying for the home, its linked annexes and chargeable expenses.
Effort rate = (annual rent / annual net income) × 100
The result must be ≤ 30%.
For the calculation of this rate, the amount of income and liabilities resulting from the documentation required and provided by the applicant will be taken into account.
1-bedroom homes are for units of up to 2 members (including the dependency home) and 2-bedroom homes are for units of up to 4 members (including adapted homes).
The family unit shall be understood as the one defined in the protected housing legislation (Annex I, Decree 91/2020, Plan Vive Andalucía 2020-2030).
A cohabitation unit is understood to be the group of people who habitually and permanently live in and enjoy a home, with a vocation for stability, regardless of the relationship between them.

No, it is not optional. All homes will come with a garage space and a storage room as annexes, inseparably linked to the home for the duration of the rental contract.
As an applicant, you may reject the home that has been assigned to you; in that case, your application will be excluded from the list of interested parties.
No, the homes are delivered unfurnished. The kitchen is delivered equipped with upper and lower cabinets, sink, faucet, ceramic hob, extractor hood and oven. Likewise, the bedrooms have wardrobes.

The general award conditions establish the following:
For the assignment of adapted homes, three groups will be established based on the following lists: wheelchair users, people with reduced mobility and people with other disabilities. Accordingly, priority in the assignment of adapted homes will be given first to wheelchair users, in second place, people with reduced mobility, and third, people with other disabilities.
There will be 8 adapted 2-bedroom homes for family or cohabitation units of up to 4 members, which will be awarded to those who prove they are wheelchair users, people with reduced mobility, or have other disabilities.
The priority in assigning adapted homes is, first, wheelchair users, second, people with reduced mobility, and third, people with other disabilities.

The call is published at least 7 calendar days before the start of the deadline in the Official Gazette of the Province of Málaga, on the website of the Instituto Municipal de la Vivienda de Málaga, on the City Council's notice board and, additionally, on the Superficiario's website.
The deadline for submitting applications will be 15 business days, counted from the day indicated in the announcement of the call on the website of the Instituto Municipal de la Vivienda de Málaga and on the Superficiario's website.
Once the declaration of responsibility has been correctly submitted through the electronic office, the applicant will be able to automatically download a receipt proving submission of their application.

Your registration on the list of interested parties is valid from the moment it is recorded until the lease contract is formalized.
In addition, the applicant or, where applicable, the awardee, may withdraw their application at any point in the process prior to signing the lease contract. During the initial phase of receiving and processing applications managed by the Instituto Municipal de la Vivienda de Málaga, the withdrawal must be carried out through the channels enabled by that body.
In later phases of the procedure, withdrawal may be carried out through the channels enabled by the Superficiario, or by sending an email to the address solicitudAlquiler@sogeviso-am.com, indicating in all cases the application code (ID) and the DNI/NIE of the applicant.
As an applicant, you will not be able to choose a specific home, but you will be able to select the type of home that best suits your needs (1 or 2 bedrooms). Likewise, during registration you can indicate whether you need an adapted home or a home for a person in a situation of dependency.
Once the application submission period has ended, the Instituto Municipal de la
Vivienda de Málaga will draw up a provisional list of applications submitted for this
call.
Once the period for objections to the provisional list of submitted
and resolved applications has ended, the Instituto Municipal de la Vivienda de Málaga will approve and
publish the final list of applications, including the order number assigned to
each application, which will be used in the draw. The draw will be
carried out by the Instituto Municipal de la Vivienda de Málaga, before a public notary,
by drawing a number from among those corresponding to the applications
included in the final list. Starting from the number drawn, the order
of the applications will be established, in ascending order, until all of them are covered,
continuing from the beginning of the list if the end is reached. The result will
produce a single Ordered List of Selected Applications.
Yes, the result of the draw will produce the following ordered
lists:
- Ordered List of Selected Applications for 1-bedroom homes,
corresponding to the 15 non-adapted homes.
- Ordered List of Selected Applications for 2-bedroom homes,
corresponding to the 178 non-adapted homes.
- Ordered List of Selected Applications for the non-adapted 1-bedroom
home, intended for People in a Situation of Dependency.
- Ordered List of Selected Applications for adapted 2-bedroom
homes, corresponding to the 8 adapted homes.
Within each of these lists, the following will be identified:
‒ As selected: the first applications selected until the number
of homes to be awarded in each case is reached.
‒ As alternates: the following selected applications until a number
equivalent to double the corresponding homes is reached.
‒ As a waiting list: those applications that retain their position on the list
without having the status of provisional selectees or alternates.
The provisional assignment of a specific home will be made following the order
established in the corresponding Ordered List of Selected Applications,
provided by the Instituto Municipal de la Vivienda de Málaga.
Within each list, homes will be assigned following the ascending
objective order of the homes:
‒ FIRST, based on floor: from the top floor down to the bottom.
‒ SECOND, based on the door letter or number: in alphabetical order (A, B, C…) or
ascending order (1, 2, 3…).
‒ If there is more than one block or entrance in the same development, homes
will also be assigned in alphabetical or ascending order.
If you reject the home offered, you will be excluded from the list and the home is assigned to the next interested party on the list, to an alternate or, if the lists are exhausted, to whoever the Superficiario designates among applicants who meet the requirements.
From the verified receipt of the request, you have 15 business days to submit the necessary documentation through the channel indicated to you.
If the applicant submits the supporting documentation incompletely, the Superficiario will require them to correct the deficiency or provide the required documents within the period indicated in the request, and the total period for responding to documentation requests may not be shorter than that provided for in the applicable regulations, indicating that failure to do so will result in exclusion.
Failure to submit on time, non-compliance with requirements, or falsehood in the application will result in exclusion from the list and loss of favored-applicant status.
The applicant must state their acceptance or rejection of the home within the period indicated in the corresponding communication. In the event of express rejection of the assigned home, or failure to respond within the indicated period, the applicant will be definitively excluded from the procedure, and that specific home will be offered to the corresponding alternate application in accordance with the order established on the list.
The lease contract must be formalized within a maximum period of 1 month from the full accreditation of compliance with the requirements, as well as from the issuance of the corresponding certificate by the IMV and provided that the homes are habitable.
Yes, the applicant must continue to meet the access requirements at the time of signing of the contract and must report any significant change in their situation.
The lease contract must be signed by all persons of legal age who are part of the cohabitation unit, in accordance with the provisions of the award bases.
Yes, the legal deposit provided for in the Urban Leases Act is mandatory, and the Superficiario may also require an additional month's rent as an extra guarantee.
If, for reasons attributable to the applicant, the contract is not signed within the one-month period, the Superficiario may make the home available again and withdraw the application, and the applicant will lose their status as awardee.
Rent is paid by bank direct debit to the IBAN account provided for the formalization of the contract.
Rents are reviewed annually based on the percentage change experienced during that period by the National General Index of the Consumer Price Index System, published by the Instituto Nacional de Estadística, or any indicator that replaces it.
Yes, the Superficiario may periodically require proof of your income during the term of the contract to verify compliance with the requirements.
Failure to effectively occupy the home within a maximum period of 3 months from the delivery of the keys, without justified cause, is grounds for termination of the lease contract.
At the end of the contract, you may request its renewal provided that you continue meeting the access requirements for protected rental housing and the regulations applicable at that time.
You must notify the Superficiario, who will reassess compliance with requirements and may determine whether it is appropriate to modify (novate) the rental contract or terminate it.
Yes, you can withdraw your application at any time before signing the lease contract, through your private area or by sending an email to the address indicated in the bases, including the application code and your ID.
Notifications will be sent to the email address that the main applicant indicated in the application for this specific municipal call, without prejudice to any communications that, during the initial phase of the procedure, may be made by the Instituto Municipal de la Vivienda de Málaga through the channels it has enabled for that purpose.
Yes, pets are allowed. Pet ownership must comply with the provisions of the lease contract and the development's Regulations, where the rules of coexistence, possible restrictions and responsibilities of the tenant are detailed.
