Lagoom Living homes are intended, solely and exclusively, for rental. There is no possibility of purchase or rent-to-own. These are affordable homes under a rental regime.
It may be applied for by natural persons of legal age, with full civil capacity, who meet the requirements of these terms and the current regulations on protected housing in Málaga; if there is a family unit, the application refers to its members.
No, neither the applicant nor any member of the family unit may own another home, protected or unprotected, nor hold a real right of enjoyment or lifelong use over it, either at the time of submitting the application or on the date of signing the award document.
Yes, the awarded home must constitute the habitual and permanent residence of the applicant family unit and must be occupied within the legally established deadlines.
Yes, the applicant must have been registered in the municipality of Málaga for at least one year immediately prior to the date of submitting the application. It is not necessary for all members of the cohabitation unit to meet this requirement; it is enough for the applicant to meet it.
At the time of submitting the application, you must have filed an application as a protected housing applicant in the Málaga Municipal Registry of Protected Housing Applicants, keeping that application active at least until the formalization of the rental contract, in accordance with the actual situation of the family or cohabitation unit and its income.

Remember that the only way to submit the application is through the Málaga Municipal Housing Institute, using the standardized responsible declaration form provided for the present call, through the electronic registry or procedure enabled at the municipal electronic headquarters.
You must prove minimum income per family or cohabitation unit (last completed fiscal year) of: €23,400 annually for 2-bedroom homes (including adapted homes), and €27,700 annually for 3-bedroom homes.
The development includes homes intended for family or cohabitation units with
income of up to 2.5 times the IPREM and homes with income of up to 4 times the
IPREM.
The maximum income per family or cohabitation unit equivalent to 2.5 times
the IPREM,
with corrective coefficients applied, is limited to: €24,418.60 annually for
units
of 1 member, and €32,307.69 annually for units of 2 members or of 3 or more
members.
The maximum income per family or cohabitation unit equivalent to 4 times the
IPREM,
with corrective coefficients applied, is limited to: €39,069.77 annually for
units
of 1 member, and €51,692.31 annually for units of 2 members or of 3 or more
members.
Family income is considered as defined in protected housing legislation, taking as reference the general and savings taxable bases of personal income tax (in the 2024 tax return, boxes 435 and 460), for the last tax period with an expired filing deadline for the members of the family unit.
Annual income is calculated by adding the general and savings taxable bases of each member of the cohabitation unit with income.
For this purpose, the amounts of the general taxable base and the savings taxable base are considered, as regulated in articles 48 and 49, respectively, of Law 35/2006, of 28 November, on Personal Income Tax, corresponding to the tax return(s) filed by each of the members of the family unit for which the home is intended, relating to the last tax period with an expired filing deadline, at the time the application is submitted.
Annual net income is obtained from the last three payslips, certificates of state-recognized benefits and income from economic activities, where applicable.
You must include the income of all members of your cohabitation unit who receive any type of income.
The rent will be determined in accordance with publicly protected housing
regulations and
calculated based on the useful surface area of the home and its annexes, applying
the maximum
prices per square meter legally established:
Maximum rental price €/m2 useful area of home = €5.54.
Maximum rental price €/m2 useful area of annexes = €3.75.
Likewise, chargeable expenses and services will be added to the rent as set out
in the
lease agreement.
The chargeable expenses will be those arising from the community services of the development (among others, and by way of example only, those corresponding to gardening, cleaning, maintenance, the swimming pool and utilities for the common areas), which may be charged monthly to tenants together with the rent for the home and its annexes.
Yes, as a tenant you will need to set up and manage the individual utilities of your home (electricity and water). However, the lease agreement will include the information necessary to make this process easier.
Yes, as a solvency requirement, the total annual rent to be paid (rent for the home, linked annexes and estimated chargeable expenses) cannot exceed 30% of the annual net income of the cohabitation unit (effort rate).
The effort rate is an indicator that measures what percentage of a cohabitation unit's annual net income is spent on paying for the home, linked annexes and chargeable expenses.
Effort rate = (annual rent / annual net income) × 100
The result must be ≤ 30%.
For the calculation of this rate, the amount of the income and liabilities resulting from the documentation required and provided by the solicitant will be taken into account.
2-bedroom homes (including adapted homes) are for units of up to 4 members, and 3-bedroom homes are for units of up to 6 members.
Family unit shall mean that defined in protected housing legislation (Annex I, Decree 91/2020, Plan Vive Andalucía 2020-2030).
A cohabitation unit is considered to be the group of people who live in and enjoy a home on a regular and permanent basis and with a vocation for stability, regardless of the relationship between them.

As an applicant, you can reject the home that has been assigned to you; in that case, your application will be excluded from the list of interested parties.
No, the homes are delivered unfurnished. The kitchen is delivered equipped with upper and lower cabinets, sink, tap, ceramic hob, extractor hood and oven. Likewise, the bedrooms come with wardrobes.

The general award conditions establish the following:
For the allocation of adapted homes, three groups will be formed based on the following lists: wheelchair users, reduced mobility and other disabilities. In this regard, priority in the allocation of adapted homes goes first to wheelchair users, in second place, reduced mobility and in third place other disabilities.
There will be 7 adapted 2-bedroom homes for family or cohabitation units of up to 4 members, which will be awarded to those who prove to be wheelchair users, people with reduced mobility or other disabilities.

The call is published at least 7 calendar days before the start of the period in the Official Gazette of the Province of Málaga, on the website of the Málaga Municipal Housing Institute, on the City Council's notice board and, additionally, on the Superficiario's website.
The submission period is 15 business days counted from the publication of the announcement of the call on the website of the Málaga Municipal Housing Institute and on the website of the Superficiario.
Once the responsible declaration has been correctly submitted through the electronic headquarters, the applicant will be able to automatically download a receipt confirming the submission of their application.

We will keep you updated on the acceptance of your application and, if a home is assigned to you, we will notify you to continue with the submission of the necessary documentation.
In addition, once the application submission period has ended, information will be provided on the updated list of interested parties, where you can check the status of your application.
Your registration on the list of interested parties is valid from the moment it is recorded until the formalization of the rental contract.
In addition, the applicant or, where applicable, the successful bidder, may withdraw their application at any time before signing the rental contract. During the initial phase of receiving and processing applications managed by the Málaga Municipal Housing Institute, the withdrawal must be carried out through the channels enabled by that body.
In later phases of the procedure, withdrawal may be carried out through the channels enabled by the Superficiario, or by sending an email to the address solicitudAlquiler@sogeviso-am.com, indicating in all cases the application code (ID) and the DNI/NIE of the applicant.
As an applicant, you will not be able to choose a specific home, but you will be able to select the housing typology that best suits your needs (2 or 3 bedrooms). You will also be able to indicate during registration whether you need an adapted home.
Once the application submission period has ended, the Municipal
Housing Institute of Málaga will prepare a provisional list of applications
submitted under the present call.
Once the deadline for objections to the provisional list of applications
submitted has ended and been resolved, the Málaga Municipal Housing Institute will
approve and
publish the final list of applications, including the order number assigned
to each application, which will be used in the draw.
The draw procedure will be carried out by the Málaga Municipal Housing Institute,
before a notary public, by drawing a number from among the
numbers corresponding to the applications included in the final list. Starting from
the
number drawn, the order of the applications will be established, in ascending
order,
until all of them are completed, continuing from the beginning of the list in
the event of reaching its end. The result will produce a single Ordered List of
Selected Applications.
Yes, the result of the draw procedure will produce the following ordered
lists:
- Ordered List of Selected Applications for 2-bedroom Homes,
corresponding to the 129
non-adapted homes.
- Ordered List of Selected Applications for 3-bedroom Homes,
corresponding to the 39
non-adapted homes.
- Ordered List of Selected Applications for Adapted 2-bedroom
Homes,
corresponding to the 7 adapted homes.
Within each of these lists, the following will be identified:
‒ As selected: the first applications selected until completing
the number of homes to be awarded in each case.
‒ As alternates: the next applications selected until completing a
number equivalent to double the corresponding homes.
‒ As waiting list: those that retain their position on the list without
having the status of provisionally selected nor of alternates.
The provisional allocation of homes will be carried out following the
ascending order of the
list resulting from the draw. Each applicant will be assigned the first available
home
that corresponds to them according to the eligibility criteria set out in these
terms, applying the following objective and predetermined order of homes:
‒ FIRST, by floor: from the top floor down to the lowest.
‒ SECOND, by door letter or number: in alphabetical order (A,
B, C…) or ascending order (1, 2, 3…).
‒ If there is more than one block or entrance in the same development, homes
would also be assigned in alphabetical or ascending order.
If you reject the home offered, you will be excluded from the list and the home is assigned to the next interested party on the list, to an alternate or, if the lists are exhausted, to whoever the Superficiario designates among applicants who meet the requirements.
From the moment you are notified of the assignment, you have 15 business days to submit the necessary documentation through the channel indicated to you.
If the applicant provides the supporting documentation incompletely, the Superficiario will require them to remedy the deficiency or provide the required documents within the period indicated in the request, with the total period to respond to documentation requests being no shorter than that provided for under applicable regulations, and will indicate that, should they fail to do so, they will be excluded.
Failure to submit on time, non-compliance with requirements or false statements in the application will result in exclusion from the list and loss of favored applicant status.
The applicant must state their acceptance or rejection of the home within the period indicated in the corresponding communication. In the event of express rejection of the assigned home, or failure to respond within the indicated period, the applicant will be excluded definitively from the procedure, with that specific home then being offered to the corresponding alternate application according to the order established on the list.
The rental contract must be formalized within a maximum period of 1 month from the complete accreditation of compliance with requirements, as well as from the issuance of the corresponding certificate by the IMV and provided that the homes are habitable.
Yes, the applicant must continue to meet the access requirements at the time of signing the contract and must report any significant change in their situation.
The rental contract must be signed by all adults who are part of the cohabitation unit, in accordance with the provisions of the award terms.
Yes, providing the legal deposit required under the Urban Leases Act is mandatory, and the Superficiario may also require an additional month's rent as extra security.
If, for reasons attributable to the applicant, the contract is not signed within a period of one month, the Superficiario may dispose of the home and withdraw the application, and the applicant will lose their status as successful bidder.
Rent is paid by direct debit to the IBAN account provided for the formalization of the contract.
Rents are reviewed annually based on the percentage change experienced in that period by the National General Index of the Consumer Price Index System, published by the National Statistics Institute, or any indicator that replaces it.
Yes, the Superficiario may periodically require proof of your income during the term of the contract to verify compliance with the requirements.
Failure to effectively occupy the home within a maximum period of 3 months from the delivery of keys, without justified cause, is grounds for termination of the rental contract.
When the contract ends, you can request its renewal provided you continue meeting the access requirements for protected rental housing and the regulations applicable at that time.
You must inform the Superficiario, who will reassess compliance with the requirements and may determine whether it is appropriate to amend (novate) the rental contract or terminate it.
Yes, you can withdraw your application at any time before signing the rental contract, through your private area or by sending an email to the address indicated in the award terms, including the application code and your DNI.
Notifications will be sent to the email address that the main applicant indicated in the application for the present specific municipal call, without prejudice to any communications that, during the initial phase of the procedure, may be made by the Málaga Municipal Housing Institute through the channels it has enabled for that purpose.
Yes, pets are allowed. Pet ownership must comply with the provisions of the rental contract and the Development Regulations, where the rules of coexistence, possible restrictions and responsibilities of the tenant are detailed.
